In consideration of being permitted to participate in “BARK IN THE PARK” night at Wilkins Stadium, I agree to the following:

1.     Leash and Control. I will keep my dog on a leash and under my control at all times while on Wichita State University (“WSU”) property, including but not limited to Wilkins Stadkum.

2.     Designated Areas. I agree to keep my dog only in areas designated by the Wichita State University Intercollegiate Athletic Association, Inc. and/or their designees (“ICAA”).

3.     Cleanup. I will promptly clean up after my dog and dispose of all waste in appropriate containers.

4.     Responsibility for My Dog. I understand and agree that I am fully and solely responsible for my dog and my dog’s actions while on Wichita State University property. I accept full responsibility and liability for any injury, damage, or loss caused by my dog to any person, animal, or property.

5.     Removal of Unruly Dogs. ICAA reserves the right, in its sole discretion, to require any owner to remove their dog from the event if the dog is aggressive, disruptive, or otherwise poses a safety concern.

6.     Photos / Publicity. I hereby consent to any publicity, including the use of my name and likeness, and waive any right to inspect and/or approve any images, recordings or other record (e.g., photography, film, videotape, recordings or advertising copy, etc.) which may be used in connection with my participation or attendance at the event including, but not limited to social media accounts. I understand that I will not be compensated in any way for such use.

7.     Assumption of Risk and Release. I acknowledge and understand that participation in Bark in the Park and bringing my dog onto WSU property involves certain risks, known and unknown, including but not limited to the risk of injury to myself, my dog, or others, damage to property, and risks associated with interactions between dogs, people, crowds, noise, and stadium conditions. I understand that these risks cannot be eliminated. I knowingly and voluntarily assume all such risks in consideration for being permitted to participate in this event. To the fullest extent permitted by law, I hereby release and discharge the State of Kansas, Wichita State University, the Wichita State University Intercollegiate Athletic Association, Inc., and their officers, employees, agents, and representatives (“Releasees”) from any and all claims or liability, including claims arising from negligence, related to my participation in the event or my dog’s presence at the event.

8.     Release of Liability. I, for myself and on behalf of my heirs, successors, assigns, and personal representatives, hereby release, waive, and forever discharge Releasees from any and all claims, demands, causes of action, or liability of any kind, including claims arising from the negligence of the Releasees, to the fullest extent permitted by law, for any injury, damage, or loss to persons or property arising out of or related to my participation in Bark in the Park or my dog’s presence at the event, including but not limited to claims for personal injury, property damage, medical expenses, and attorneys’ fees.

9.     Indemnification. I, for myself and on behalf of my heirs, successors, assigns, and personal representatives, agree to defend, indemnify, and hold harmless the Releasees from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to my participation in Bark in the Park or my dog’s actions or presence at the event.

10.  Covenant Not to Sue. I agree that I will not sue, and will not seek any money or judgment from, the Releasees for any injury, loss, or damage to me or my property arising out of or related to my participation in this event or my dog’s presence at the event.

11.  Severability. I agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Kansas. If any provision of this Release is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

12.  Governing Law and Venue. This Release shall be governed by and construed in accordance with the laws of the State of Kansas. Any legal action arising out of or relating to this Release or the event shall be brought exclusively in the state or federal courts located in Sedgwick County, Kansas.

By checking the box below and participating in this event, I certify that, to the best of my knowledge, my dog is current on all required vaccinations and is not suffering from or carrying any contagious or transmissible disease. I further acknowledge and represent that I have carefully read and understand this Release and Waiver, that I am signing it freely and voluntarily, that I am legally competent to do so, and that I am the owner or lawful handler of the dog I am bringing to the event. I understand and agree that this Release and Waiver is binding upon me and, to the extent applicable, my heirs, successors, assigns, and personal representatives.
